GLOSSARY

Here are some helpful definitions to help you

  • "You" means the person who places an order for goods or services or whose order for these is accepted by Tiger Modular
  • "Goods" means the product items (including services such as any instalment, provision of parts. delivery etc) which Tiger is to supply in accordance with these conditions.
  • "We" “us” means the Tiger Modular business
  • "Conditions" means our standard terms and conditions of sale and (unless the context otherwise requires) includes any special terms and conditions agreed in writing between the two parties.
  • "Contract" means the contract for the purchase and sale of the goods.
  • "Writing" means email or post. It does not mean by fax, or by message or posted comment on any social media platform

Any reference to any provision of a statute shall be a reference to that provision as amended, re-enacted or extended at the relevant time.

APPLICATION OF THESE TERMS AND CONDITIONS

It is considered that any customer entering into an agreement with Tiger Modular Ltd is in acceptance of these terms and conditions. The customer is responsible for obtaining a copy of these terms and conditions for their reference.

Tiger Modular Ltd reserves the right to amend these terms and conditions at any time.

No variations of these terms and conditions shall be of any effect unless agreed by the Company in writing.

If any part of this Agreement is declared unenforceable or invalid, the remainder will continue to be valid and enforceable.

The contract shall in all respects be construed and operated as an English contract governed by English law and any dispute arising out of, or in connection herewith, shall be referred to the English courts.

A copy of these terms and conditions will be emailed to the customer as part of the order confirmation.

PURCHASING

All orders are an offer to buy goods pursuant to these Terms and Conditions, subject to acceptance by us.

PRODUCT

The company website, design checklists and any elevation drawings serve as a guide only and do not form part of any contract.

The company make every effort to be as accurate as possible however precise measurements indicated on our website, in our marketing and on any order documentation are subject to reasonable levels of tolerance.

The company reserves the right to alter specifications without prior notice. Changes to product specification are rare and reasons for doing so may include, but are not limited to, improving general quality or efficiency of the product, because the material is no longer available to the company or for drastic changes in material costs. The company will always endeavour to inform the customer when any significant specifications are to be amended.

PRICING

Any prices shown are inclusive of any value added tax at the current rate and are shown in sterling.

All costs will be set out clearly to you before you place your order or summarised by the customer sales adviser when ordering by telephone. We adhere to a transparent pricing policy; no discounts other than those advertised on our marketing material or agreed in writing with a Director will be applied.

Prices, offers and products are subject to availability and may change before (but not after) we accept your order.

Once the customer approves the 3D design drawing and the deposit payment is received, a payment confirmation will be issued and the price stated will remain fixed, unless the order is put on hold for longer than 90 days.

All necessary information is correct at the time of presentation, but mistakes do happen. If an error is made regarding the price or description of any item ordered, you will be notified and asked if you still wish to continue with the order.

PAYMENT PROCESS

Once the online quote is accepted, this activates the in-person site survey and 3D design drawing being produced. If after the point the client cancels, the expense of this prior service will be invoiced at a fixed price of £350 inc VAT

On approval of the 3D design drawing a deposit will be required (in-line with the terms stipulated on the quotation) 4 weeks prior to the install date. The Final payment of the outstanding balance is due strictly within 7 days of completion.

If additional minor works (i.e. plastering, groundworks, electrics, decking) or any remedial action is required after the main installation, a proportionate retention (reflecting the cost of outstanding work) is agreed between Tiger Modular Ltd and the customer until the outstanding works are completed.

PAYMENTS

Any outstanding balance may be paid by bank transfer (copy of transaction required) or by debit or credit card unless other arrangements are made. All goods remain the property of the company until the final balance is paid for in full.

We accept card payments via Mastercard, Visa, American Express, Visa Debit and most other credit and debit cards commonly accepted in the United Kingdom. All credit card payments are subject to a + 2% surcharge on the invoice value.


You must use a valid credit or debit card and ensure that there are sufficient funds or credit facilities to meet the cost of the Order. Steps may be taken to verify the authenticity of the relevant card before supplying the Goods.

We do not accept cheques.

Finance is available through Klarna (please see below), but please note this is subject to customer status and Tiger Modular has no influence over subject acceptance.

If you would like to pay by different means for each stage of the payment process, please advise us beforehand.

Full payment (or a finance agreement in place) is required before your ownership of your order is confirmed. We reserve the right to refuse to accept any order for any reason.

You are responsible for ensuring the accuracy of your order (including name, full delivery address, contact details and any applicable specification) and providing all necessary information to enable us to perform the Contract.


Finance
Klarna is a Swedish payment service provider that takes end-to-end responsibility for your payment.

There are 5 payment terms on offer

  • 6 months or 12 months at 0% interest
  • 24 months, 36 months, or 48 months at 9.9% APR

Klarna require a deposit (currently 10% of the total sum) payable up front to them. This is separate to any deposit payment referred to that is required payable direct to Tiger Modular.

If a subsequent finance application is declined, and you decide not to continue with the order, any deposit paid to Klarna should be refunded in full.

Please not however that this is only in case of a declined application. Any order using finance is subject to the standard Tiger Modular cancellation policy as a bespoke product.

CANCELLATIONS

As all Products designed and manufactured by Tiger Modular are made-to-order, to customer specifications, they are exempt from cancellation rights. You have no cancellation rights if your order is for a bespoke, customised, or personalised product.

The customer may cancel an order and receive a full refund up to 35 calendar days before the scheduled base installation date. For avoidance of doubt, the scheduled installation date will have been confirmed shortly after the 3D design drawing approval.

If the customer cancels an order once the balance of the deposit has been paid, no refund will be given. The customer accepts that the balance of the deposit is non-refundable as once this payment has been made to the company the order is put into full production.

If the customer cancels an order once the foundation ground screws have been laid they will forfeit the total sales price in full unless an alternative agreement has been confirmed between the customer and Tiger Modular.

The company reserves the right to cancel an order at any time, for any reason. In the event of Tiger Modular cancelling an order, a full refund will be given to the customer.

If you wish to cancel an order, you must contact Tiger Modular immediately. The notification should be in writing preferably via email to [email protected].


Some items are delivered to you directly from the manufacturer from third party. Should you wish to cancel and return these after delivery (you have up to 14 days to do so), and they are unused and in their original packaging, please contact the Tiger Modular customer service team on 0113 537 0552 or email [email protected] for return methods and costs.



ORDERS ON HOLD

If a customer is not ready to proceed with an installation date they may place their order ‘on hold’ in which case any deposit will remain on account with Smart Modular. Prices will remain fixed for a period of 90 days from the date the order is put on hold, after which any recent price updates will be applied to the order.

Orders may remain on hold for a period of 12 months before they are automatically cancelled. The customer will be contacted at this time so that they may provide details for the refund of the holding deposit. No refund will be issued if the customer has been supplied with AutoCAD/ Drawing documents.

PLANNING PERMISSION

Planning consent is not normally required however, it is the customer’s responsibility to ensure that planning consent is not required for the installation of the outbuilding. We recommend you seek clarification from your local planning authority. Smart Modular will not be held liable for any breach of Permitted Development/Planning regulations applicable to your property.

If the site is in a Conservation Area we recommend that the customer contacts their local authority to confirm whether or not any Article 4 Directions (restrictions on your Permitted Development rights) have been applied to the property.

If the customer has been provided with AutoCAD/ Drawing documents and they choose to cancel their order then the £350 inc VAT expense will be invoiced and must be paid within 5 days, this is then subject to 5% daily interest for each day not settled.

The customer is responsible for ensuring that their building and its location complies with their Planning Approval conditions. Smart Modular will not be liable for any changes a customer may make to the design, specification or location of a building once a Planning Application has been submitted or approved.

SCHEDULED DATES

The company will always try to honour the estimated delivery/installation date, 99% of our buildings are delivered and installed within the estimated time. However, we cannot guarantee the installation date and cannot be held responsible for postponement or delay outside of our control, this may include but is not limited to extreme weather conditions, access difficulties, parking, traffic or global supply issues.

The company cannot be held liable for any loss, damages, charges or expenses incurred by the customer as the direct or indirect result of any delay in the delivery, installation or completion of an order. The company will not be held financially liable for return visits that may be required for any rectification works to the building.

Any time frames given to the customer to suggest the duration of an installation are an estimate only and do not form part of any contract. The company will not guarantee to complete the installation of a building by any specified date or time.

If the customer postpones/delays the installation of the base or building for any reason after payment of the 50% deposit has been made, the following penalties will be immediately incurred;

  • Within 30 days of the scheduled foundation installation date: 50% of the total sales price;
  • Any time after the foundations has been laid: 100% of the total sales price.

For any works booked in for optional upgrades, including but not limited to electrical connections, air conditioning installations, blind installations, plastering, landscaping, the full charges will still apply if the customer cancels such work any time after the date(s) have been confirmed with the customer.

WORK ON SITE

The customer is responsible for preparing the site as per the written notes on their order acknowledgement and any discussion that takes place with the Site Surveyor at the time of sale. (Inc removal of sheds/obstructions and shrubs etc)

The customer is responsible for providing all necessary parking permits, access and permissions in advance of the foundation and building installation dates. Access to electricity and water is required on site, including the full use of wash and welfare facilities. If no means of welfare available, the client must provide temporary toilets and wash facilities. Tiger Modular can arrange the hire of portable facilities but this is an optional upgrade and fees apply, prior notice must be given 15 days before the install start date, but preferably at the time of site survey so arrangements can be made and costs agreed. 

In accordance with the Site Preparation Notes all sites/foundations must be level, a clearance of no less than 400mm is required in addition to the external dimensions of the building to allow construction.

Failure to complete the necessary preparations may result in a delay or, in certain circumstances, cancellation of the installation schedule. A minimum charge of £500 will be incurred if the customer has not carried out the necessary preparations as per clauses 9.1, 9.2 and 9.3. Including the cost of any further expenses such as accommodation and labour.

The company will not deliver or install products through domestic buildings, over fences or other obstacles without prior consultation and written agreement.

Whilst every care is taken to avoid any damage to the Customer’s property, Tiger Modular cannot be held liable for unavoidable damage caused by the installation teams. The Customer accepts that some damage may be unavoidable, especially to access routes and the surrounding working areas.

We strongly recommend that garden landscaping is completed after the building has been installed to avoid any incidental damage.

The company will install materials, fittings or appliances supplied by the customer on a good will basis only. The company will not be held liable for any damage to such items. No additional items will be fitted/installed unless agreed in writing on the Sales Order prior to the team visiting site.

The company reserves the right to withdraw its employees or designated contractors from site where they deem the working conditions to be unsafe in accordance with current Health and Safety Regulations. In such cases the company will discuss any necessary changes to the working environment/conditions with the customer which must be carried out before works can continue.

All installation personnel have been trained and briefed on safe working practices including use of PPE (Personal Protective Equipment) in accordance with current Health and Safety regulations.

Tiger Modular Ltd are covered by liability insurance up to £1 million and £10 million employer’s liability. Full details are available on request.

The design consultation completed at the time of sale is a visual inspection only and the company cannot be held liable should any underground obstruction be discovered on commencement of works.

The company reserves the right to cancel or postpone any works should unforeseen circumstances arise that affect the company’s ability to fulfil an order. In the event that the company cancel the total installation of an order a full refund will be given to the customer, unless it is found that such unforeseen circumstances have been directly caused by the customer.

BASES/FOUNDATIONS

The customer must be present on the base date and is responsible for confirming the location of the base prior to construction. Once this position has been confirmed and base constructed the position cannot be changed. The customer should consider any areas surrounding the building that may be obstructed or restrict access to openings on or around the garden room.

No apertures or fittings for services not supplied by Tiger Modular will be made unless agreed and confirmed in writing on your Sales acknowledgement.

If an existing base has been used e.g. concrete slab, Tiger Modular cannot be held liable for subsidence or settlement issues.

Spoils created by the base team will not be removed from site unless agreed in writing prior to the works commencing.

The Company will not be held liable for any issues with regards to the height of the building if the customer has not levelled the site/ground in accordance with the Site Preparation Notes. All bases are levelled from the highest point of virgin ground.

ELECTRICAL WORKS

A Part P certificate will only be supplied where Tiger Modular completes a full external connection of power and will only be supplied to the customer once the final balance has been paid in full. The certificate can take up to 21 days to process. Where a full connection has not been made, readings are available on request. It is the responsibility of the certified electrician completing the full connection to certify the electrical works.

Every effort is made to provide an accurate quotation for electrical works, however, the inspection of the customer’s own armoured cable and consumer unit is only visual and is based on the assumption that the customer’s electrics comply with current building regulations. It is the customer’s responsibility to ensure that the existing cable is fit for purpose. Quotes given at the point of sale are estimates only and do not act as confirmation of the cable being suitable. Tiger Modular cannot be held liable should the cable prove to be unsuitable or inadequate and upgrades required.

Tiger Modular reserves the right to refuse to complete electrical work or to apply additional charges where a connection is not possible with the current power source/consumer unit. The customer will be informed and quoted prior to any necessary additional works being carried out.

Where Tiger Modular are to complete a connection of an existing cable or of a cable to be supplied by the customer, it is the customer’s responsibility to run the cable from the main fuse board in the house to the garden room site. The customer must ensure that there is an excess of at least 10 metres of cable reaching the site. Unless otherwise stated on the customer’s Sales Order, Tiger Modular will not complete any of the works to run the cable, this includes clipping the cable to any boundary/wall/fence. Should the customer request that such work is completed additional charges will apply.

The company reserves the right to make any changes to electrical product specification or services they deem necessary to ensure safety compliance. The customer will be made aware of any such requirements and cost implications before the relevant works are carried out.

Armoured electrical and Ethernet cables are always run above ground by the quickest and most direct means, such as fences or walls. Underground trenches or buried services are charged in addition to the quoted value, Tiger Modular have the right to refuse to undertake underground exactions if deemed necessary.

No additional electrical work will be carried out by the company or designated sub-contractors unless agreed in writing on the Sales Order prior to the team visiting site.

Tiger Modular makes no guarantee as to the suitability of any WiFi powerline adapter. The liability of the Company for any Internet or Communications device or service will be limited to none. Any wiring supplied by us will be tested and passed, devices, hardware and existing WiFi is the responsibility of the client.

DELIVERY

Some of our items, including Pergolas and optional extras such as certain kinds of roofing and others may delivered to you directly from the manufacturer through a third party, these will arrive by a different delivery method normally a short period before you receive your building. The supplier and ourselves will inform you of the delivery dates.

We will keep you informed of any delay in completing your Order and take the necessary steps to fulfil the order as quickly as possible.

We do not consider the estimated delivery dates as part of the contract and are under no liability for any delay or failure to deliver unless the delay

  • Is attributable to us
  • Is considered unreasonable and no delivery date can be stated
  • you have specifically made ‘time of the essence’ in writing.

If the delivery location is outside our standard delivery zone, the delivery period may be longer than promoted standard timings. Timescales will be communicated to you at point of order and at points throughout the production process.

Where installation is not part of your Tiger Modular order – such as building kits -  please do not arrange any third party assembly or installation of your product for the same day as delivery.  All components of your Tiger Modular delivery should be checked before arranging installation or assembly.

Delivery Address
Unless otherwise agreed in writing, the goods will be delivered to the address specified in the order. Orders placed using finance can only be delivered to the billing address.

Order completed
Your order should be checked as soon after it is delivered as possible to ensure all components are present and satisfactory. If any part of the order is missing, damaged, faulty or does not comply with the specifications you must notify us as soon as practicable.

We may require photographic evidence of any complaints, defects, requests to return a product or claims of incorrect or incomplete product delivery, which should be submitted to [email protected]

Missing or damage items
If you provide evidence that items are missing or damaged, we will replace or repair any necessary parts to complete your agreed initial order.

Incorrect or faulty product
If we send you an incorrect or faulty item you will be offered a replacement, repair or offered a refund and exemption from collection costs. Any item to be returned or replaced must be in the same condition as delivered.

Refunds
Refunds due to amended purchases or cancellation made prior to delivery within the permitted time (please see Cancellations section above) will be processed by us within 5 working days of the order amendment or cancellation of all or part of the order.

Refunds for orders that have been delivered and are subsequently cancelled, found to be faulty, damaged, or unwanted will made within 5 working days of the day of receiving the items back or the day on which you provide evidence of their return whichever is earliest.

Please allow a further 3-5 working days for your card or finance provider to process the refund back to your account.

We may reduce the amount of the reimbursement if any action taken by yourself reduces the value of the goods supplied.

PROMOTIONAL OFFERS

We sometimes offer special promotions for a limited time only. These offers are displayed around the site and are clearly marked. Promotional offers are only applicable to products which are clearly marked on site. Offers are valid until the end date featured in the promotion.

Vouchers and discounts issued by other companies in the Woodlands Home & Garden Group – such as Tiger Sheds – are not available on Tiger Modular products. 

PRODUCT MAINTENANCE AND GUARANTEE

Tiger Modular buildings are covered by a comprehensive guarantee, which is activated once the final balance is paid in full. We provide an Aftercare document, with maintenance guidance and guarantees outlined.  A quick guide for these terms is as follows:

LIFETIME: Structural foundations

40 YEARS: Modular Roof System

10 - 20 YEARS: Door systems (guarantee length depending which manufacturer profile used)

10 YEARS: Design and manufacturing faults to the building structure (including rot and corrosion)

3 YEARS: Internal misting in double glazing: Door and window hinges and locks; External decking (rot, corrosion and structural faults)

1 YEAR (OR PRODUCT MANUFACTURERS OWN GUARANTEES): External fascias;  Internal linings and trim, floor covering, internal accessories, blinds; Electrical installations and appliances, including underfloor heating and air conditioning units Electrical and network connections.

Buildings constructed by Tiger Modular under ‘Permitted Development’ should not be used for habitable accommodation. If used for habitable accommodation the guarantee is invalid. Guarantee excludes normal ‘wear and tear’ and decorated surfaces.

No guarantee will be made by TigerModular against the effects of weather exposure on the colour of the external cladding. Cedar will naturally fade and silver over time, it is recommended that that any cedar is treated by the customer within 1 month of installation and every 6 months thereafter to preserve its original colour, or alternatively follow the guidance of a professional decorator or treatment manufacturers guidelines.

Door adjustments are not covered under guarantee and may be necessary from time to time. Adjustments can be easily carried out by the customer – please call the office for guidance or alternatively seek a local tradesman service to perform minor adjustments.

Warping of timber fascia boards is not covered under guarantee; timber is a natural product and warping may occur and we cannot control the movement of timber.

Superficial cracking of timber cladding and/or fascia boards and/or decking is not covered under guarantee.

Tiger Modular guarantee glass on windows and doors in accordance with the ‘Glass and Glazing Federation’ guidelines (a copy can be obtained from our operations team). No guarantee will be made against scratches or imperfections in/on the glass once the sign-off of the building inspection has been completed.

Where underfloor heating has been installed the customer must ensure that all furniture is raised on legs, the use of flat- base furniture will invalidate your guarantee.

Guarantee claims should be made to the main office on discovery of the fault. Failure to report a fault immediately may invalidate your guarantee. Once agreed, a maintenance team will be despatched to remedy the issues free of any charge. Tiger Modular Ltd will not reimburse payments made to third party repair contractors without prior written consent, we do not accept consequential loss.

If the customer is deemed to be responsible for any faults to the building, all costs associated with remedial works will be charged to the customer.

No guarantee will be made for materials, appliances or services supplied by the customer to be installed by Tiger Modular Ltd. Such items are installed on a good will basis only.

The Company’s liability shall not exceed the total purchase value of the of the Product and the taking of the steps it deems necessary to rectify any issues shall constitute an entire discharge of the Company’s liability under this warranty.

The Company shall not be deemed liable for subsidence to the garden room or of the surrounding installation site unless such subsidence is caused by the negligence of the Company during installation.

Any structural alteration made to the building by the customer or a third party employed by the customer will invalidate your guarantee and as such any related remedial works will be

The Customer must ensure that adequate ventilation and drainage is in place around all sides of the building. Blocking in the sides of the building with paving or other landscaping material may result in excessive moisture retention either to the walls or to the base system. Blocking in the sides of the building will invalidate the guarantee.

For plastered buildings, Tiger Modular adheres to NHBC guidelines on internal finishes, including plastering, skirting and floor finishes. Please contact the office to obtain a copy of these guidelines. Plaster cracking over 2mm wide is covered under your guarantee for a period of 1-year.

It is the responsibility of the customer to ensure that the building is well ventilated during the plaster drying process. The company will not be liable for any cracking or moisture retention caused by lack of ventilation during the drying process.

Ventilation - Maintenance

We strongly advise that all buildings are regularly aired, with doors or widows opened when the weather permits, and a low form of heating is maintained throughout the year

If the building is being used as a gym or exercise room it is important to maintain good ventilation. We recommend heating and ventilating your building before use and during use to avoid condensation on equipment.

Ground, Gutter And Roof  - Maintenance

Tiger Modular products require zero maintenance however, it is the customer’s responsibility to ensure areas around the building are kept clear. An air gap under the sides and rear of the building must be maintained and clear of obstacles to ensure vegetation and weeds do not make contact with the building and lead to possible intrusion within the building. This will also ensure that no moisture cannot be trapped underneath the building.

Gutters and roofs should be inspected and cleared of all debris a minimum of twice a year.

As with any external building, failure to clear gutters and keep air gaps maintained may result in damage to the fabric of the building which will invalidate your guarantee.

If remedial work is carried out and the defect is found to be a result of the customer failing to maintain a clear area around the building the work will be chargeable to the customer (as per clause

PRIVACY AND SECURITY

You may visit this website and access the public information while remaining anonymous and not revealing any personal information. Tiger Modular may record details of the domains from which users visit this site and analyse the data generated to assess trends, statistics, and customer’s needs. Information and data may be automatically collected through cookies. Users should familiarise themselves with the operation of cookies. Most browsers are initially set up to accept cookies. If you wish to make an online purchase from us, then you will be required to provide certain personal information as a prerequisite of being able to place an order. Tiger will only ask you for as much information as required to process your order and perform distribution effectively.

Supplied information will be retained by Tiger Modular for as long as required, kept secure and in accordance with the requirements of the 1998 & 2018 Data Protection Acts, and not be transferred to any party outside the European Economic Union. You may contact Tiger Modular at any time and request a copy of all information stored on our system that is personal to you to ensure it is correct and up to date. Please note in some instances there may be an administration fee charged for the provision of this data if the request is deemed excessive.

In accordance with our security policy, Tiger  Modular will endeavour to ensure that the ordering system is on a secure server and encrypted to prevent security breach and your information kept secure and not intercepted by a third party. Under no circumstances will Tiger Modular hold sensitive payment details, such as your card number, expiry date and security code. All transactions are handled through our accredited payment bureaux: Opayo. For more information on the privacy policies of this bureaux, please refer to https://www.sagepay.co.uk/.

Any content and or information which you provide to Tiger Modular must be legal, truthful and comply with all applicable laws and regulations.

Tiger need to pass on your delivery details to our delivery partners, our 3rd party suppliers and their delivery partners in order to fulfil your order.

If you have placed an order with us choosing a finance option, Tiger reserves the right to pass on your contact details to our finance provider Klarna, who will contact you with a loan decision and, if your application is successful, arrange for loan payments with you.

As previously stated, Tiger Modular reserve the right to alter the website at any time. This includes altering the products, the content, the descriptions, and the prices. Tiger Modular also reserves the right to alter these terms and conditions at any time.

CUSTOMER IMAGES

Tiger Modular reserves the right to approve, disapprove or display any customer submitted images for use at our own discretion.

Use of customer images includes but is not limited to, marketing and promotional purposes both electronic and print, customer, and product galleries online, and various social media outlets.

This use may be uncredited and without fee or permission.

COPYRIGHT AND MONITORING

The copyright in all material provided on this site is held by Tiger Modular or by the original creator of the material. Except as stated herein, none of the material; may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without the prior written permission of Tiger or the copyright owner.
